Commission Policy - Outside Agents

As a home seller, South Haven Homes deeply values the important role real estate agents play in supporting their clients, and we cherish these relationships. As the industry evolves, our commitment to delivering the best possible experience for our homebuyers and their representation remains important to us.


In pursuit of that goal, our current policy is that we will pay a commission of up to 2.5% of the base price for a Property that the buyer causes to be built (i.e. pre-sale) or up to 2.5% of the base price for a Property that the Seller has caused to be built (i.e. spec or quick move-in).*

Registration. By registering your Buyer with South Haven Homes, you establish agency as a representative of the Buyer. If the Buyer purchases and closes on any property with South Haven Homes, you will receive a commission subject to the terms and conditions outlined below.


Commission Amount. South Haven Homes agrees to pay a commission of up to 2.5% of the base price for a Property that the Buyer causes to be built (i.e. pre-sale), or up to 2.5% of the base price for a Property that the Seller has caused to be built (i.e. spec or quick move-in). For the purposes of this agreement, “base price” is interpreted to mean the final purchase price minus options amount and seller concessions for a Property that the Buyer causes to be built (i.e. pre-sale), or the final purchase price minus seller concessions for a Property that Seller has caused to be built (i.e. spec or quick move-in).


Terms and Conditions. The commission will be paid to Buyer’s Brokerage only under the following terms and conditions:

  1. The Buyer’s Agent must register the Buyer on the Buyer’s initial visit to the site, or prior to the Buyer’s first contact with Seller or Seller’s Agent. To register a Buyer, the Buyer’s Agent must do at least one of the following:
  2. Buyer’s Agent is physically present at Buyer’s initial visit to the site.
  3. Buyer’s Agent has communicated with one or more of Seller’s Agents via text, email, or phone call and shared Buyer’s name and contact information prior to Buyer’s first contact with Seller or Seller’s Agent. There must be a written record of the conversation.
  4. In the event registration, as defined above, has not been met, then the Buyer-Broker compensation will be reduced by an amount determined by South Haven Homes in its sole discretion.
  5. If the Buyer or Buyer’s Agent has not made contact with South Haven Homes through one of its Seller’s Agents regarding the Buyer’s transaction within 60 days of Buyer or Buyer’s Agent’s last contact with Seller, Buyer’s Agent must re-register the Buyer with South Haven Homes.
  6. From the time Buyer is registered with South Haven Homes until the closing, funding, and recording of the Property, Buyer’s Agent is to be communicative with and responsive to Seller’s Agent, Buyer, and any other individuals or organizations with a vested interest in the transaction including, but not limited to, title companies, designers, lenders, South Haven Homes’ superintendents, and South Haven Homes’ closing coordinator. Additionally, Buyer’s Agent must exhibit professionalism and courtesy to Seller and all interested parties. Failure to remain engaged and abide by the terms outlined above throughout the transaction may result in a reduction of commission by an amount determined by South Haven Homes in its sole discretion.
  7. The payment of commission by the Seller’s Brokerage is conditioned upon a successful closing of the real estate transaction between Buyer and Seller and shall be due at the closing as defined in the Real Estate Purchase Agreement between Buyer and Seller.


Seller’s Agent Rights. Seller’s Agent reserves the right to:

  1. Show the Buyer the product, answer buyer questions, and communicate directly with the Buyer as necessary.
  2. Write the contract using the South Haven Homes Real Property Purchase Agreement and other South Haven Homes documents or addenda.
  3. Conduct any other business, directly with the Buyer, as is necessary to consummate the transaction.
